Terms of Service

These Terms of Service (“Terms”) govern your use of the SpudDB mobile app and related services (the “Service”) provided by SpudDB (“we”, “us”). By creating an account or otherwise using the Service, you agree to these Terms.

Eligibility and accounts

You must be at least 13 years old to use the Service and capable of forming a binding contract. You are responsible for the accuracy of the information you provide when registering and for keeping your password confidential. You are responsible for all activity that occurs under your account.

You retain ownership of the photos, videos, and other content you upload. You grant SpudDB a worldwide, non-exclusive, royalty-free license to host, store, process, display, and transmit your content solely to operate, improve, and secure the Service. When you contribute content within an organization, other members of that organization may also view and use that content within the Service.

Service availability and changes

We work to keep the Service available, but we do not guarantee uninterrupted access. We may modify, suspend, or discontinue features at any time. We will give reasonable notice of material changes that affect you.

Termination

You can stop using the Service at any time and may delete your account from within the app (Settings → Delete Account). We may suspend or terminate accounts that violate these Terms or that we believe pose a security or legal risk. Sections of these Terms that by their nature should survive termination — including ownership, disclaimers, liability limits, and dispute resolution — will continue to apply.

Disclaimers

The Service is provided on an “as is” and “as available” basis. SpudDB and its suppliers disclaim all warranties to the maximum extent permitted by law, including warranties of merchantability, fitness for a particular purpose, and non-infringement. Crop analyses produced by the Service are estimates and decision-support outputs, not professional agronomic advice; you remain responsible for your business decisions.

Limitation of liability

To the maximum extent permitted by law, SpudDB will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amounts you paid us for the Service in the twelve months preceding the claim or USD $100.

Indemnification

You agree to indemnify and hold SpudDB harmless from claims arising out of your content, your use of the Service, or your violation of these Terms.

Governing law

These Terms are governed by the laws of the State of Washington, USA, without regard to its conflict-of-laws principles. Any disputes will be resolved in the state or federal courts located in King County, Washington, and you consent to personal jurisdiction there.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice in the app or by email. Your continued use of the Service after a change takes effect constitutes acceptance of the updated Terms.
